This legislation was the first in the UK to define what a disposable<\/a> is. The document describes a single-use device as a kit that isn\u2019t refillable, rechargeable, or both.<\/p>\n\n\n\n

What does \u2018refillable\u2019 mean?<\/h2>\n\n\n\n

The Government stated a refillable e-cigarette is a device that hosts refillable pods, which are sold separately and easily replaced. <\/p>\n\n\n\n

What does ‘rechargeable\u2019 mean?<\/h2>\n\n\n\n

The draft legislation defines a rechargeable device as a vape designed for reuse that features replaceable coils and pods.<\/p>\n\n\n\n

The descriptions of what constitutes a vape to be disposable is presented in the Scottish \u2018Environmental Protection Regulations 2024\u2019<\/a>. This introduces sanctions for businesses that sell prohibited items and grants new powers to local authorities and enforcement officers.<\/p>\n\n\n\n

The draft states that a business found to supply, offer to supply, or possess single-use vapes is liable to a fine between \u00a35000-\u00a310,000. With the possibility of a prison sentence of up to two years in severe cases.<\/p>\n\n\n\n

The legislation will also allow further fines for businesses who refuse to comply with a premise search. Likening to the above the penalty parameters are a \u00a35000-\u00a310,000 fine or a two-year maximum prison sentence.<\/p>\n\n\n\n

The document also reveals potential local authority powers. This will allow them to distribute warrants on businesses and suppliers suspected of stocking\/producing dangerous vapes and disposable products.<\/p>\n\n\n\n
