Italian E-Cig Tax Suspended


The Tar Lazio regional court has suspended the tax on e-liquids without nicotine, and has sent the entire legislation to the constitutional court, the very same court that last year struck down previous e-cigarette taxes. 

The Italian Vape magazine Agivape wrote, ‘currently there is a €3.73 + 22% tax per 10ml of e-liquid with or without nicotine. The level of taxation has been decided by AAMS after an evaluation of the equivalence in terms of smoking time with respect to the traditional cigarettes.’ This ‘equivalence’ was arrived at despite there not being any evidence for it. 

The Italian e-cigarette market has collapsed under the weight of such taxation, with the government now very disappointed according to Agivape, as it was expecting 115 million euros in revenue from it, yet only manage to raise 3.5 million, due to sales going abroad. 

Agivape wrote, ‘Mr. Massimiliano Mancini, president of Anafe Confindustria (the producers trade association) sounds satisfied with this suspension, but not too much. “Unfortunately, it’s like watching again the same movie, given the reasons of the decisions, which confirmed what the Court already said several months ago. We wasted a huge amount of time and money. This and the previous tax system blocked all the investments and the growth, it’s a pretty unique situation“. 

This decision by the Italian court came the very same day that UK Prime Minister mentioned that e-cigarettes were a legitimate way to move away from tobacco.
